    Non-compliant toy

    All traders such as the manufacturer, importers and distributors are responsible for the conformity of the toy.

    The placing on the market of a toy is not subject to prior inspection or approval by the supervisory authorities. For example, a market surveillance authority may assess the conformity of the toy placed on the market by testing it or requesting an economic operator to provide it with the EC declaration of conformity, technical documentation, and other information.

    Where a business suspects that a toy which it has placed on the market or sold does not meet the requirements, it must take immediate action to:

    • bring the toy into conformity,
    • withdraw the toy from the market, or
    • where appropriate, organise a recall procedure for it.

    Where the properties of the toy present a risk to safety, health or the environment, the business must immediately inform the authorities of the member states in which the toy was sold, giving details of the non-compliance and of any corrective measures taken.
