EU Declaration of Conformity
The manufacturer or its authorised representative must prepare and sign the EU declaration of conformity before the electrical product is placed on the market. The EU declaration of conformity is prepared and signed as part of the conformity assessment procedure. The EU declaration of conformity is the document which states that the electrical product meets all the essential requirements of the applicable legislation. By preparing and signing the EU declaration of conformity, the manufacturer assumes responsibility for the conformity of the product.
Like the technical documentation, the EU declaration of conformity must be kept for 10 years from the date on which the electrical product was placed on the market. If the product has been imported from outside the EU, the importer is responsible for keeping the copy of the original EC declaration of conformity.
The EU declaration of conformity is a standardised document, the template of which can be found on Tukes’ website or in regulations.
If several EU regulations that require an EU declaration of conformity apply to the electrical product, a single EU declaration of conformity can be drawn up for all regulations. The EU declaration of conformity can also be a document that consists of all the individual manufacturer’s declarations of conformity that apply to the product.
The EU declaration of conformity must be made available to the market surveillance authorities on request. The provision on some categories of equipment such as machinery, equipment used in potentially explosive atmospheres, radio equipment, measuring instruments, pleasure crafts and lifts requires the equipment to be accompanied by an EU declaration of conformity.
The EU declaration of conformity must be translated into the language(s) required by the member state on the market of which the product is placed or made available. However, the legal provisions do not specify who is obliged to translate them. If the translation is made by an economic operator other than the manufacturer or their authorised representative, a copy of the original declaration signed by the manufacturer must be attached to the translation.
The EU declaration of conformity of a product on the Finnish market must be available in Finnish, Swedish, or another language approved by the market surveillance authority. If the legislation requires that the product must be accompanied with the EU declaration of conformity, or that the information in the EU Declaration of Conformity must be provided in the operating instructions, the EU Declaration of Conformity must always be translated into both Finnish and Swedish.
