    Product’s non-conformity

    All economic operators, manufacturers, importers and sellers are responsible for the conformity of the product. The placing on the market of a product is not subject to prior inspection or approval by the supervisory authorities. However, a market surveillance authority may assess the conformity of the product placed on the market by testing it or requesting the businesses to provide it with the EU declaration of conformity, technical documentation, and other information, for example.

    If the business suspects that the product it has placed on the market is not in conformity with the requirements, it must immediately take steps to bring the product into conformity, withdraw it from the market, or arrange a recall procedure when necessary. If the product’s features present a risk to safety, health or the environment, the business must immediately inform the market surveillance authority of the product’s non-compliance and of all the corrective measures it has taken.
